Terms and Conditions for Avon Au Pair Agency

  1. These terms and conditions are deemed to be accepted by the Applicant on completion and submission of the registration form. Completion of registration, forms a contract of agreement between the Agency and the Applicant.
  2. These Terms and Conditions shall govern the contract of agreement between the Agency and the Applicant at all times.
  3. the Agency shall be known as The Client or Applicant. The Client refers to a person or persons or company who engage the services of The Agency to find and place a suitable Au Pair for a pre-arranged fee. The Au Pair will henceforth be referred to as the Applicant.
  4. The introduction of the Client to an Applicant and all information pertaining to that Applicant is strictly confidential.
  5. The Agency will use all reasonable efforts to introduce potential Applicants to the Client. Following the choice of an Applicant by the Client, the Agency will attend to the administration to assist the Applicant's placement and will provide advice to the Client and the Applicant whenever required.
  6. The Agency will make every endeavour to place a suitable Applicant for every appointment. However, it is the responsibility of the Client to satisfy itself as to the suitability of the Applicant before they arrive. Both the Client and the Applicant are therefore STRONGLY ADVISED to check all details personally. The Agency cannot and shall not offer any warranty as to the medical fitness, character or suitability of the Applicant or Client and shall not accept any liability for any damage, loss, theft, expense, injury or inconvenience - whether direct, indirect, consequential or by omission - resulting from the engagement of the Applicant through the introduction made by the Agency to the Client. The character and suitability of an Applicant may not be judged by creed, colour or nationality.
  7. The Applicant warrants and agrees that:
    a. The information contained in the completed registration form is complete and correct.
    b. He/she has read and will comply with the rules concerning the relevant type of help.
    c. He/she will at all times behave in a reasonable and responsible way towards the Client.
    d. The Client is entitled to a minimum of 14 days notice, in writing, of termination.
  8. It is the responsibility of the Client to procure/check all legal paperwork in the engagement of the Applicant. For instance work permits, visas, medical documents etc. The Agency should be provided with copies of these, by the Applicant, for immigration requirements and for reference.
  9. If the Client requires the Applicant to drive, it is the full responsibility of the Client to check the driving credentials and to insure the Applicant for use of the car. The Agency cannot give any warranty over the Applicant's ability to drive.
  10. Hours of work and pay as well as holiday entitlement and details of expected duties should be clearly set out as far as is possible, before commencement of the Applicant begins. It is the responsibility of the Applicant to look at these carefully before accepting a position to ensure satisfaction.

    Replacements
  11. As soon as a suitable agreement has been reached between Client and Applicant, the Client must inform the Agency and the precise start date of employment provided. The Applicant must also convey this information to the Agent. A copy of Letter of Invitation must then be provided to the Agency before a placement can be confirmed.
  12. As soon as the Agency advises the Client of a prospective suitable match with an Applicant and facilitates the introduction, the Client may not contact that Applicant through another agency and the Applicant may not initiate contact through another agency.
  13. In the event of the Applicant cancelling a placement with a Client or failing to arrive, then the Agency will make a charge of £50.00 to the Applicant to cover Agency administration costs.
  14. In the event of a Client being found unsuitable for the Applicant after all reasonable efforts by all parties have been made, and the Applicant wishes to stay working as an Au Pair in the UK, the Agent will make every reasonable attempt on their behalf to introduce a suitable Client to them. It is the discretion of the Agent as to whether a £50.00 charge will be made to the Applicant for administrative charges.
  15. If during the first 4 weeks of the Applicant's stay a material inaccuracy is shown on the host's application form, the Applicant may terminate his/her employment.
  16. The Client may ask the Applicant to leave by giving a minimum of 14 days written notice. A copy of this notice must also be provided to the Agent. However, any serious misconduct, agreed by all parties, on the part of the Applicant, allows the host family to end his/her employment immediately.
  17. The Agency shall not be liable or responsible for any breach of conduct or terms of engagement by the Applicant.
  18. The Agency reserves the right to remove the Applicant from the Client at any time if Terms & Conditions have been breached, false information given or employment guidelines have been flouted.
